Crest Rewards ProgramTerms & Conditions Enrollment & Participation Participation in the Crest Whitestrips Rewards Program (“Crest Rewards Program”) is open to dental professionals in the U.S. and Canada who currently are enrolled in a Crest Whitestrips ship plan of 12 cases or more per 12-month period. Employees of Procter & Gamble Company, its reward supplier, and their affiliates are not eligible to participate in the Crest Rewards Program. Program participants who enroll in the program will earn 1000 points per case of Professional Crest Whitestrips or Crest Whitestrips Supreme purchased through February 28, 2006, provided that no points will accrue nor will eligibility for enrollment be based on cases sold at student pricing. Points will be credited to Crest Rewards accounts 4 to 6 weeks after product has shipped. Crest Rewards points will be deducted from Crest Rewards accounts for all returns of qualifying product. If a participant does not receive credit for any particular qualifying purchase, then the participant may address such inquiries to: Procter & Gamble Company Customer Billing Department, 1-800-543-2577. No account adjustments will be made after the expiration of 120-day period following purchase of qualifying products. Points Points accrued in a participant’s account do not constitute property of the participant, have no cash or monetary value and cannot be transferred by operation of law or otherwise. Points are not transferable to other programs administered by Procter & Gamble Company or any award suppliers. Points will only begin to accrue once a participant is enrolled. All points accrued must be redeemed no later than eighteen (18) months from the date of the participant’s enrollment. If a participant does not accrue or redeem any points for a period of 365 days, the participant will be placed on inactive status and will not receive any further account statements or program notices. If the participant does not accrue or redeem any points for an additional 180 days, then his/her participation in the program will be terminated and all points will be forfeited. Subsequent re-enrollment does not entitle that individual to reinstatement of forfeited points. Once points are deducted from the participant’s account, charges, re-issuance or re-credits of points is not allowed. Points are not transferable. However, an award certificate can be issued to a person other than the account holder at the written request of the participant. Award All award redemptions will be issued through the Crest Rewards section of Dentalcare.com. Rewards points will be deducted from the account at the point the redemption is confirmed. For merchandise rewards the product will ship to the address supplied by the participant at the time of redemption. Travel awards will consist of a travel award certificate which must be complete with preferred travel dates and locations from the provided list and mailed to the award supplier designated on the certificate within 4 months of redemption of the award. Travel must take place within 12 months of the reward redemption. Please allow six week after time of redemption for award to be delivered. Procter & Gamble and the award suppliers will not be responsible for, and will not replace, awards, award certificates, or correspondence which are lost or misdelivered. All awards are subject to availability and the terms and conditions appearing on the travel reward certificate if applicable. This includes, but is not limited to, expiration dates and restrictions on usage. Once an award has been issued, neither Procter & Gamble Company, its designated agents nor the respective vendors will take it back, exchange it, or re-credit the participant’s account. If P&G or any award supplier improperly denies a participant an award or some other benefit, the participant’s exclusive remedy shall be the issuance of the improperly denied award or benefit if available, or such other alternative comparable benefit as determined by P&G, which shall have no additional liability whatsoever. In no event shall P&G be liable to any participant, or anyone claiming through a participant, for any direct, indirect or consequential damages, or lost revenue or profits, arising out of P&G or any award suppliers’ acts or omissions in connection with this program. P&G and its respective parent organizations, affiliates, officers, directors, shareholders, agents, employees, subsidiaries, promotional agencies or independent contractors are not responsible for late, lost, misdirected, incomplete, undeliverable or destroyed rewards, award notifications, or any other information related to this program resulting from any hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures or faulty transmissions or for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, or redemption information not received by P&G or its agent on account of technical problems or traffic congestion on the Internet, or at a Website, or any combination thereof including any injury or damage to participant's or any other person's computer related to or resulting from participating in this program. Tax Participants are responsible for the payment of all incidental charges and applicable state, federal, and all other taxes that may be assessed while participating in the Crest Rewards Program. Earning of points and redemption of awards are subject to all applicable laws and regulations. Benefits and awards may be subject to income or other taxes. Such taxes and all disclosures related thereto are the sole responsibility of the participant or award recipient. Awards hold no monetary or credit value. General Terms and Conditions The sale or barter of any points, award certificates, awards or other benefits is prohibited. Any points, certificates or benefits which Procter & Gamble Company deems to have been sold or assigned may be cancelled. Fraud or abuse concerning the program is subject to administrative and/or legal action by Procter & Gamble Company, including, but not limited to, forfeiture of all accrued points in a participant’s account, cancellation of any awards previously issued, and/or termination of the participant’s participation in the program. Procter & Gamble Company will not be liable for any act, omission or negligence of any supplier of an award under this program including, but not limited to, any air carrier, travel agent, hotel, car rental location or retailer. MERCHANDISE AND TRAVEL SERVICES ARE PROVIDED “AS IS.” PROCTER & GAMBLE COMPANY MAKES NO REPRESENTATION OR WARRANTY OF ANY KIND REGARDING ANY SERVICE OR MERCHANDISE FURNISHED AS AN AWARD UNDER THE PROGRAM INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WHICH ARE EXPRESSLY DISCLAIMED. Procter & Gamble Company will not be responsible for any costs, damages, accident, injury, loss, expense, or inconvenience that may arise in connection with the use of or a defect in any such service or item by program participant or any other person. Any benefits, offering or the like relating to the Crest Rewards Program shall not be construed as, or constitute a contract or otherwise establish a contractual relationship between Procter & Gamble Company and any participant. All questions or disputes involving the application or interpretation of the program and conditions will be decided by Procter & Gamble Company in its sole discretion. By registering to participate in the program, participants agree to allow Procter & Gamble Company to use their name in conjunction with such promotional advertising and printing as Procter & Gamble Company shall deem appropriate, without compensation for such use. Participants also agree to receive emails regarding this program and Procter & Gamble products and services. P&G reserves the right to audit any and all accounts at
any time and without notice to the member to ensure compliance with program
rules. In the event that an audit reveals discrepancies or violations, the
processing of rewards and summaries may be delayed until the discrepancies
or violations are resolved satisfactorily to P&G. Pending such resolution,
participants may be prohibited from redeeming points for a reward or ticket
as determined in P&G’s sole discretion. |
